Elite Service provides residential and light commercial heating, ventilation, and air conditioning (HVAC) services, including repair, installation, replacement, and maintenance. The specific scope of any work will be described in the estimate, invoice, or service agreement provided to you. We reserve the right to refuse or discontinue service at our discretion.
Estimates and quotes are provided based on the information available at the time and the condition of the equipment or property as observed. Final pricing may change if the actual scope of work differs from what was originally assessed, if additional parts or labor are required, or if hidden conditions are discovered during the work.
Our diagnostic visit is offered at a flat rate as advertised. Any repair or installation work will be quoted to you for approval before it begins. Prices for parts and equipment are subject to change based on supplier availability and market conditions.
Appointment times are estimates and may be affected by weather, prior jobs, parts availability, and emergencies. You agree to provide safe and reasonable access to the areas where work is to be performed. If our technicians are unable to access the property or perform the work due to conditions outside our control, a trip or service fee may apply.
If you need to cancel or reschedule an appointment, we ask that you notify us as far in advance as possible. Repeated missed appointments may be subject to a fee.
Payment is due upon completion of the work unless other arrangements have been agreed to in writing. We accept the payment methods identified on your invoice. Financing may be available on qualifying purchases through third-party providers, subject to their approval and terms. Past-due balances may be subject to late fees and collection costs to the extent permitted by law.
We stand behind our workmanship. The specific warranty terms for labor and any installed equipment will be described in your invoice or service agreement. Manufacturer warranties on parts and equipment are provided by the respective manufacturers and are subject to their terms and conditions. Warranties may be voided by misuse, neglect, unauthorized modification, or service performed by others.
Our satisfaction guarantee applies as described at the time of service. It does not cover issues caused by factors outside the scope of the work we performed.
You agree to provide accurate information about your property and equipment, to disclose any known hazards, and to maintain a safe work environment for our technicians. You are responsible for securing pets, valuables, and fragile items, and for obtaining any permissions required for us to perform the work if you are not the property owner.
If you enroll in a membership or service plan, the benefits, pricing, and billing terms will be described at the time of enrollment. Memberships are flexible and may be adjusted or cancelled, subject to the terms disclosed to you. Annual subscriptions may be non-refundable. Benefits apply only while the membership is active and in good standing.
By providing your phone number, you consent to receive calls and text messages from us regarding appointments, service updates, and, where you have opted in, marketing. Message and data rates may apply. You can opt out of text messages at any time by replying STOP, and you can opt out of marketing emails using the unsubscribe link. We may still send you non-marketing messages related to your service.
All content on our website, including text, graphics, logos, and images, is the property of Elite Service or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our content without our prior written permission.
Our website may contain links to third-party websites and reference third-party manufacturers and products. We are not responsible for the content, policies, or practices of any third party. Any equipment we install is covered by the applicable manufacturer warranty, which is separate from our workmanship warranty.
In Short: The Services are provided on an as-is basis to the extent permitted by law.
Except as expressly stated in these Terms or in a written service agreement, the Services and our website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website will be uninterrupted, error free, or free of harmful components.
To the fullest extent permitted by law, Elite Service and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the specific service giving rise to the claim.
You agree to indemnify and hold harmless Elite Service and its owners, employees, and agents from any claims, damages, losses, or expenses, including reasonable attorney fees, arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Oklahoma, unless otherwise required by applicable law.
